GP360 Insight – Terms of Service

1. Agreement to Terms

These Terms govern your access to gp360insight.com and any investigative or advisory services provided by GP360 Insight (GP360 LLC), a Virginia-licensed Private Security Services Business (DCJS License #11-30333). By using our site or engaging our services, you agree to these Terms.

2. Nature of Services; No Legal Advice

GP360 Insight provides private investigative, background, and due-diligence services for individuals and businesses. Our reports and findings are informational and are not legal advice. Clients should consult their own legal counsel for advice on how to use any information we provide.

3. Lawful Purpose; Client Representations

You agree to request and use GP360 Insight services only for lawful purposes and to comply with all applicable laws. You will not use our services to stalk, harass, defame, discriminate, or otherwise violate any law. You represent that you have a legitimate reason and authority to request an investigation and that all information provided to us is truthful and accurate.

4. FCRA Disclaimer and Limitations

GP360 Insight is not a consumer reporting agency and does not furnish “consumer reports” or “investigative consumer reports” as defined by the Fair Credit Reporting Act (FCRA, 15 U.S.C. §1681 et seq.).

Our reports and findings are provided solely for informational and due-diligence purposes to assist clients in making personal or business decisions. They may not be used to determine an individual’s eligibility for employment, housing, credit, insurance, or any other FCRA-regulated purpose. Clients expressly agree to use GP360 Insight’s reports only for lawful, non-FCRA purposes.

5. Confidentiality

We handle matters with discretion and maintain confidentiality of all client information, except where disclosure is required by law, authorized by you, or necessary to protect our legal rights. Clients agree to maintain confidentiality of GP360 Insight’s reports and communications and to use them only for their intended, lawful purpose.

6. Deliverables and Use Limitations

Our reports and findings are for the client’s internal use only and may not be resold, republished, or distributed without our written consent. All investigative information provided by GP360 Insight is intended for general insight and verification purposes only. We make reasonable efforts to provide accurate and up-to-date information from reliable sources; however, public-record and third-party data are inherently subject to error or omission. GP360 Insight does not guarantee the completeness, accuracy, or future applicability of any information provided.

7. Identity Verification and Cooperation

We may require proof of identity or engagement authority before beginning work. We reserve the right to decline or terminate services if lawful purpose or authorization cannot be verified. Clients agree to provide timely and accurate information to facilitate investigations.

8. Fees, Retainers, and Cancellations

Service fees, retainers, and billing terms are outlined in your engagement letter or proposal. Unless otherwise agreed in writing, investigative retainers are non-refundable once work has begun. Clients remain responsible for approved expenses (e.g., database access fees, court records, travel, etc.).

9. Compliance and Recordkeeping

We comply with all applicable federal, state, and local laws, including Virginia Department of Criminal Justice Services (DCJS) regulations. We maintain records for the period required by DCJS or longer as needed to fulfill legal obligations or defend claims.

10. Intellectual Property

All methodologies, templates, and written materials created by GP360 Insight remain our intellectual property. Clients receive a limited, non-exclusive license to use deliverables solely for their own internal, lawful use related to the specific engagement.

11. Disclaimers

Services and information are provided “as is.” To the fullest extent permitted by law, GP360 Insight disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific outcome or result.

12. Limitation of Liability

To the fullest extent permitted by law, GP360 Insight’s total liability for any claim arising out of or relating to services or these Terms shall not exceed the total amount paid by the client for the specific engagement giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless GP360 Insight (GP360 LLC), its owners, and employees from and against any claims, damages, liabilities, and expenses arising out of your misuse of our services, violation of law, or breach of these Terms.

14. Termination of Services

We may suspend or terminate work at any time if required by law, for nonpayment, or if misuse or unlawful activity is suspected. Upon termination, you remain responsible for all fees and costs incurred through the date of termination.

15. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia without regard to conflict-of-law principles. Exclusive venue for any dispute shall lie in the state courts of Arlington County, Virginia, or the U.S. District Court for the Eastern District of Virginia, Alexandria Division.

16. Changes to Terms

We may update these Terms from time to time. The latest version will always be posted on gp360insight.com and will apply immediately upon posting. Continued use of our site or services after an update constitutes acceptance of the revised Terms.

18. Client Responsibilities

Clients are solely responsible for ensuring that their use of GP360 Insight reports complies with applicable laws. Clients agree not to use any report or information provided by GP360 Insight to make employment, housing, or credit decisions governed by the Fair Credit Reporting Act (FCRA). GP360 Insight assumes no responsibility for misuse of its reports by clients or third parties.
